Dealing with the complications and emotional stress of a divorce can be overwhelming for

individuals. Marriages come to an end every day - having to deal with issues such as

the division of property and debts, spousal support, child support, custody and visitation

can be very stressful. When you have done all that you can do to make the marriage

work and despite all of your efforts, divorce is imminent, it is important to make sure

Contested vs. Uncontested Divorce

Among the various types of lawyers available, you will need to turn to a family lawyer

who is experienced and efficient. Even when you are dealing with the uncontested

divorce, meaning that both of the parties agree to the terms of the divorce and there

are no disputes concerning spousal support, equitable distribution of property, child

support, custody, and visitation, a family law attorney can help you get through the

process quickly and efficiently. Many people think that because they have no issues

in dispute, that they can file the divorce pro se (on their own) – and they can.  However,

because the divorce process can be very technical, many pro se parties are not successful

in completing the divorce process and they end up hiring an attorney to complete the

divorce anyway.  Purchasing online divorce forms are not advisable because they are

“boilerplate" forms that do not apply in every case.  Many clients pay for these online

forms and then, when the judge does not enter the final divorce decree because of technical or procedural errors, or a deficiency in their pleadings, they end up having to hire an attorney anyway.  This lengthens the time to complete the divorce when they could have hired an attorney in the first place and had the divorce completed much quicker.  Our fee is comparable to the companies that charge people for online forms.  Why not pay the same or a little bit more money to hire an experienced attorney to make sure your uncontested divorce is done right?

 

If you are dealing with a contested divorce, hiring an experienced attorney is very important because you need someone to help you protect your assets and fight for your share of the marital assets.  Also, if children are involved, their well-being is at stake because custody and visitation will be decided by the judge if the parties cannot agree. Contested divorces can get very complicated because both parties tend to insist on the things that they do not want to let go or give up. In some of these cases compromise is not a solution, and it is almost impossible to achieve. In these cases, when the parties are at an impasse, the issues will have to be resolved in court.
